Terms
and Conditions:
It is Astraweb's policy to offer open, access
to the Usenet. However, as with any user-oriented service, Astraweb has certain guidelines and rules which must be enforced for
the benefit of both Astraweb SUBSCRIBERS and all other Internet
users throughout the world. Astraweb therefore requires
SUBSCRIBERS to adhere to the guidelines and terms and conditions set
forth herein.
Please read these Terms of Service carefully before opening or continuing
an account with Astraweb. By using Astraweb's
Services, you agree to comply with these Terms of Service, and Astraweb
may terminate your subscription if you fail to comply
with these terms and conditions. IF YOU DO NOT AGREE TO BE BOUND BY
THESE TERMS AND CONDITIONS, YOU SHOULD IMMEDIATELY END YOUR USE OF
Astraweb AND news.astraweb.com AND NOTIFY Astraweb
CUSTOMER SERVICE SO THAT Astraweb MAY INITIATE A CLOSURE
OF YOUR ACCOUNT.
Use of Service:
I. Astraweb usenet accounts are provided for use in conformance
with these Terms and Conditions. Astraweb reserves the right
to investigate suspected violations of the Guidelines. When Astraweb
becomes aware of possible violations, Astraweb
may initiate investigation which may include gathering information
from the SUBSCRIBER or SUBSCRIBERS involved and the complaining party,
if any, and examination of material on Astraweb's servers.
II. During an investigation, Astraweb may suspend the account
or accounts involved and/or remove the material involved from its
servers. If Astraweb believes a violation of these Guidelines
has occurred, it may take responsive action at its sole discretion.
Such action may include, but is not limited to, temporary or permanent
removal of material from Astraweb's servers, the cancellation
of news group posts, warnings to the SUBSCRIBER or SUBSCRIBERS responsible,
and the suspension or termination of the account or accounts responsible.
Astraweb, at its sole discretion, will determine what action
will be taken in response to a violation on a case-by-case basis.
Violations of these Guidelines could also subject the SUBSCRIBER to
criminal or civil liability.
III. Accounts may be used for the subscribers personal use only. To ensure personal usage,
accounts may only be logged in from a single location or IP address at any one time.
IV. We have ZERO tolerance for Spammers or Flooders. Posting is a
privilege, not a right, if you post SPAM and or flood any group, your
account or posting privileges may be revoked WITHOUT PRIOR WARNING,
and you may be billed (at the discretion of the System Administrator)
for the cleanup, at $200.00 (US) per hour, plus any Collections and
or Attorney's fee's incurred in collection of this fee. What is SPAM?
it is any post(s) that is unwanted, in the group it was posted to,
in short if a group has a FAQ against commercial ad's, and you post
a commercial ad(s), on topic or not, and your reported, you are Spamming.
What is FLOODING? it is the act of filling a group(s), with unwanted
posts that are on, or off topic, pushing your point, freedom of speech
is important, but not to the point of damaging any person, and or
group to prove your point of view. If your posting access is disabled,
it will remain so indefinitely. No refunds will be issued for this
reason. No customer shall participate in pyramid schemes or email
chain letters.
V. No customer shall partake in any activities defined as illegal
under U.S. Law. This applies to, but is not limited to, both posting and receiving illegal content.
VI. The posting or receiving of any image using a model or models
under the age of 18 years whether the models are partially clothed
or unclothed is prohibited. If requested, subcribers must produce 18 U.S.C.
2257 compliance for images posted. Astraweb will forward all
relevant NNTP headers to any Law Enforcement Agency for
investigation.
Registration:
Members are asked to provide certain accurate personal information
when they sign up for our services. This information includes legal
name, electronic mail (if you have one) and street address, billing
address (if different from address), telephone number, billing information/credit
card, and the identity of the actual Customer that is accessing the
account. The personal information collected from Customers during
the registration process is used to manage each Member’s account (such
as for billing purposes) Astraweb. would like each Customer
to update any changes in their history to the billing department within
thirty days of the change.
Period of Service:
You agree to pay for the period of service you select at the time
you purchase services. This period will be specified in your service
invoice. You agree that it is your responsibility to review your service
invoice accessible on the world wide web, to ensure that the invoice
accurately indicates the period of service you requested. Your period
of service commences on the date on which your account is activated.
Customers having any questions regarding charges to an account should
contact the Astraweb. All charges are considered valid unless
disputed in writing within sixty (60) days of the billing date via
electronic mail. Adjustments will not be made for charges that are
more than 60 days old.
Renewal of Service / Cancellation of Service:
Unless specified otherwise, monthly accounts will renew automatically
at the end of the anniversary period corresponding to the plan that
you select when you purchase services. If you do not wish to renew
your account, you must notify Astraweb immediately.
Cancelled accounts will not rebill and remain active until the end of the anniversary
period. You may notify Astraweb by submitting a ticket via the Helpdesk system
* A "month" is defined as 30 days.
Refunds Policy:
Full refunds are offered if requested within 24 hours of signing up. We do not offer refunds for unused portions of your service after the 24 hour period.
Indemnity:
If, as a result of a user's actions, postings, statements, or other
activity, Astraweb is named as a defendant in a lawsuit,
threaten with legal action, has a judgment issued against it, or incurs
expense to defend itself, then the user shall indemnify Astraweb
for all expenses incurred by Astraweb to protect
or defend itself, or otherwise respond to the problem. Furthermore,
the user shall hold Astraweb harmless for the user's actions,
postings, statements, or other activity. These actions, postings,
statements or other activity could include, but is not limited to,
defamation, libel, intentional infliction of emotional distress, copyright
infringement, trademark infringement, theft of a trade secret, economic
espionage, and transmission of pornographic material.
Astraweb may revise, amend, or modify this Agreement and
any other user policies and agreements, at any time and in any manner
without notice.
